Commit to Be Fit – Terms and Conditions and Contest Rules
By signing up to the Commit to Be Fit challenge, members agree to abide by the terms and conditions and contest rules set out herein, which may be amended from time to time, and failure to do so may result in forfeiture of Commit to Be Fit and cancellation of the member's Commit to Be Fit membership.
1. Participation
To participate in Commit to Be Fit visit www.committobefit.ca and sign up as a member. The Commit to Be Fit challenge is for personal use only; businesses, corporations, joint ventures, partnerships, groups or associations are not eligible. Limit one user account per person. Once signed up as a Commit to Be Fit Member you can earn points by visiting the the website, logging into your account and doing any of the following:
A. PIN of The Day
Simply visit the YMCA everyday for the YMCA PIN of the Day. You have four days to enter the Secret PIN to earn 1 point.
B. Attend a YMCA Activity
From time to time, the YMCA will announce special events or display them on the YMCA website where we will give away Bonus Codes. Logon to the Commit to Be Fit Website and go to "How Can I Earn Points" section to see a list of activities where you can earn more points.
C. Other Ways to participateCommit to Be Fit Members may also earn points in a variety of other ways, at the discretion of the YMCA. Members can login into the Commit to Be Fit website for details on additional ways to accumulate Points. The YMCA reserves the right to alter the ways of earning Points at its discretion and any such alterations will be posted on the site.
To become and remain a registered Commit to Be Fit Member, you must have Internet access and a valid email account. The YMCA is not responsible for a member's inability to: connect to the internet, log into Commit to Be Fit website, gain access to their points account or participate in any activity associated with the Commit to Be Fit challenge, service outages or delays, computer difficulties or other technological glitches. The cost of a YMCA membership is not included in the Commit to Be Fit challenge.
By becoming a member of the Commit to Be Fit challenge, each member consents to the use of his/her entry, name, city of residence and/or photograph in any publicity carried out by the YMCA and/or its advertising agencies, without further compensation and consent to their photograph being taken for such use, without further compensation.
2. Eligibility
Participation in Commit to Be Fit challenge is open to all residents of the Greater Moncton area who are 19 years of age or older. Employees of the YMCA, their immediate families and the contest suppliers are not eligible to become Commit to Be Fit Members. You must be a member of the YMCA of Greater Moncton.
A. Participation is expressly limited to one account per person. Points have no cash value, are non-transferable, cannot be sold, exchanged or traded and may not be earned in advance. All duplicate accounts or suspected duplicate accounts are subject to cancellation without notification by the YMCA.
B. Email addresses may not be shared between members; therefore, each account must have a unique, valid email address associated with it.
C. Accounts, which have an excessive number of rejected emails, may be automatically locked, preventing the member from accessing the Commit to Be Fit account until they contact the YMCA Tech Support and provide an alternate email address. Repeated problems with email delivery to a member may result in permanent suspension of the member's account.
Members are not authorized to access any other member's account, including entering codes for prizes or awards, even if the other member is a family member. Members need to enter codes themselves to validly accumulate Points.
D. No machines, scripts or automated services may be used to access any part of The Commit to Be Fit website, accumulate any Points, or in any other way participate in the Commit to Be Fit challenge. Over usage of the Commit to Be Fit system resources, as determined solely by the YMCA, is not permitted, and are grounds for account suspension or termination at the sole discretion of the YMCA.
E. The YMCA is NOT responsible for members missing out on points due to, but not limited to, the following: errors or omissions, forgotten username and/or password; problems, updates or maintenance which affects Commit to Be Fit website at a particular time; internet, browser, server, or computer problems in general; lost codes or coupons; forgotten, expired, incorrectly entered or misspelled codes, etc.
F. Any Points redemption suspected to be inauthentic, or which is made in such a fashion as to not deduct the appropriate Points amounts, may be disqualified (not accepted), at the sole discretion of the YMCA, and the member account associated with such attempted redemption may be suspended or terminated.
G. The authorized account holder or member is defined as the natural person who is assigned to the email address by an internet access provider, online service provider, or other organization that is responsible by assigning email addresses or the domain associated with the submitted email address.
H. The YMCA reserves the right to suspend or disqualify any member from receiving a cash or prize award where YMCA, in its sole discretion, determines that the member has violated any of these rules, made any misrepresentation in connection with their Commit to Be Fit membership, or used any unintended/unannounced means to accumulate points.
I. Sharing of the Code of the Day, Bonus Codes, or other Commit to Be Fit points earnings among members is expressly prohibited. Violations will result in the termination of all violating account(s) and/or forfeiture of all accumulated Points.
J. By becoming part of the Commit to Be Fit challenge, members consent to the use of any member feedback provided on the website in any and all media without compensation.
3. Prize Awards
Every YMCA member automatically receives 1 chance to win during our draws.
A. All prizes and awards must be picked up at 30 War Veterans Ave, Moncton New Brunswick unless otherwise specified. Please allow two business day for your prize to be processed before picking up your item. The YMCA hours of operation are from Monday to Friday 5:30am - 10:00pm, Saturday and Sunday from 7:00am – 08:00pm and 09:00am – 05:00pm on holidays.
B. When picking up your prize or award, you must provide a legal, valid government issued photo ID. The address on your ID must match the one located in your Commit to Be Fit membership. Prizes and awards must be picked-up within 30 business days of redemption unless otherwise specified. Prizes and awards not picked up within 30 business days from the date of redemption will be forfeited.
C. Mailing options are at the sole discretion of the YMCA and will only be considered in extreme circumstances, or will be based on the prize or award size, weight, timeliness, and value. Member is always responsible to keep his/her Commit to Be Fit account up-to-date with current information. If the YMCA deems that an individual has extreme circumstances and a prize or award is mailed out, the YMCA is not responsible if it is lost, stolen, misdirected, or damaged. The prize or award will not be replaced with future prizes.
D. Members are responsible for any and all expenses associated with their travel to and from YMCA offices or other any location(s) associated with claiming a prize or award.
E. Commit to Be Fit will not be credited or refunded for any prize, reward, item or certificate which a Member claims but does not subsequently use.
F. Member agrees to provide only true and accurate information to the Commit to Be Fit challenge at all times. Member agrees to verify that all information in their Commit to Be Fit account profile is up-to-date and accurate by providing a valid driver's license or government issued photo ID that substantially matches the information in their profile. Commit to Be Fit Award items are not transferable. Awards may not be substituted for cash or any other items or merchandise.
G. All Award claims are subject to verification by YMCA management. All decisions made by YMCA management are final.
H. Prizes and awards will be awarded and distributed at the discretion of the YMCA.
4. How to Enter to Receive Prizes
Member Point totals are subject to adjustment, and member accounts are subject to suspension or cancellation, by the YMCA for any activity which is in violation of these terms and conditions, the applicable contest rules, or which is not in compliance with the intent of the Commit to Be Fit challenge. The YMCA shall be the sole determiner in cases of suspected abuse or violation of the Commit to Be Fit terms and conditions and the applicable contest rules, and any decision it makes relating to adjustment of Points or termination of membership shall be final and binding. Members will be notified of any such adjustments through a posting in the history log (viewable in the Transactions section of My Account in Commit to Be Fit) or through an email sent to the email address in the member's account profile. Should the member disagree with any Points adjustment or account suspension, the decision of the YMCA is final and the remedy may involve Member withdrawal from the Commit to Be Fit challenge.
The YMCA is under no obligation to provide members with any particular number of Points earning opportunities or rewards.
5. Conditions
A. Members may be required to sign a liability release prior to acceptance of an item. Pursuant to the liability release, Member will agree to hold the YMCA, their parent, affiliated companies and the board of directors, managers, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize, award or participation in the Commit to Be Fit challenge.
B. YMCA, in it sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of YMCA websites, or who is otherwise in violation of these terms and conditions and applicable contest rules. It further reserves the right to cancel, terminate or modify Commit to Be Fit if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
C. The YMCA reserves the right to make changes to these terms and conditions. Notice of any revisions will be posted to this page, so please revisit this page from time to time to ensure that you are aware of any changes to it. You are responsible for reviewing these terms and conditions periodically, and your continued use of The Commit to Be Fit website following any modifications to these terms and conditions will be conclusively deemed acceptance of any changes.
D. The YMCA reserves the right to substitute an item of equivalent or greater value should the original item become unavailable for any reason. Point values associated with any award can be changed or modified at any time. The YMCA reserves the right to limit the quantity a member can select of any specific Award.
E. YMCA reserves the right to disqualify any member from receiving a prize award, where YMCA, at its sole discretion, determines that the member has misrepresented or used unintended / unannounced means to accumulate Points.
F. Members may be asked to supply personal information. This information will not be sold to outsiders, but the aggregate information (without identifying members as individuals) will be used for marketing purposes by the YMCA and its affiliates in accordance with the Privacy Policy available at http://www.ymcamoncton.com
G. The YMCA reserves the right to discontinue, suspend or modify the Commit to Be Fit challenge at any time, including the termination of all opportunities to accumulate points. From time to time the YMCA may decrease or zero out Points in all the Commit to Be Fit accounts. At those times all accounts will either start at zero Points or be decreased by an amount or percentage to be determined by YMCA and all Points will no longer be valid.
H. This is a free contest. However, the YMCA Membership are not included in this program and are sold separately.
I. Failure to comply with the Commit to Be Fit terms and conditions and applicable contest rules may result in a member's disqualification at the sole discretion of the YMCA.
J. A written copy of the Commit to Be Fit terms and conditions and applicable contest rules are available during regular business hours at the YMCA offices or by sending a self-addressed stamped envelope to: Commit to Be Fit, YMCA of Greater Moncton, 30 War Veterans Ave, Moncton New Brunswick, E1C 0B3
K. Members may unsubscribe from the Commit to Be Fit challenge at any time. In the event your name is picked from a draw, you will not be able to receive your prize. You must have a valid active membership at the time of the draw.
L. YMCA reserves the right to close a member account after 1 month of consecutive inactivity.
Contest Rules
1. a) Contest begins Jan 1st, 2010 at approximately 12:01am and ends on March 31, 2010 at 11:59 PM (the “Contest Closing Date”).To qualify, you must be a member of the YMCA of Greater Moncton prior to March 31st, 2010 at 10:00pm. Weekly random draws, by a YMCA of Greater Moncton (“YMCA”) representative, will be made on January 8, January 15, January 22, January 29, February 5, February 12, February 19, February 26, March 5, March 12, March 19, March 26 prior to 10:00pm.
MUST HAVE A VALID AND ACTIVE YMCA MEMBERSHIP TO PARTICIPATE IN THIS CONTEST/DRAW.
b) Multiple individuals in one household may enter the contest.
2. All prizes must be accepted as awarded, may not be transferred or exchanged and may not be converted to cash. The YMCA reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised Grand Prize.
3. Participants will have a chance to win a trip for two to a sun destination. The grand prize consists of a $3,000 Amazing Vacation Travel Credit Sponsored by YMCA and CAA Atlantic Services Limited. Grand Prize cannot be sold or traded. Void if sold. Any portion of Grand Prize not redeemed will be forfeited.
4. Grand Prize: There is one (1) Grand Prize consisting of a $3,000 Amazing Vacation travel credit sponsored by YMCA and CAA Atlantic Services Limited. The travel credit is to be fulfilled exclusively through CAA Travel to be applied towards your choice of travel vacation using a major Canadian airport closest to the Grand Prize winner’s place of residence in Canada (hereinafter referred to as the “Departure Point”) if applicable. Grand Prize winner and his/her travelling companion(s) are solely responsible for all costs not expressly described herein including, without limitation, applicable taxes, fuel/currency surcharges, ground transportation, meals, beverages, room service, gratuities, merchandise, telephone calls, insurance together with any required travel documentation, and all personal expenses of any kind or nature, together with any applicable overnight layover. It is the sole responsibility of the Grand Prize winner and his/her travelling companion(s) to obtain all necessary travel documentation including passports and visas if applicable and to comply with any customs and immigration requirements. Grand Prize winner and his/her companion must book their travel arrangements by December 31st, 2010 or risk the forfeit of the Grand Prize Amazing Vacation portion. It is recommended that Grand Prize winner and his/her travelling companion(s) obtain sufficient personal insurance prior to departure.
5. Grand Prize(s) and Secondary Prize(s) (“collectively Prize(s)”) must be accepted as awarded. The Prize(s) may not be sold, transferred and is/are not convertible to cash. Contest Sponsor(s) reserve(s) the right to substitute the Prize(s) in whole or in part in the event that all or any component of the Prize(s) is/are unavailable. No change in travel arrangements can be made by the winner once the booking has been confirmed. The Grand Prize may not be used towards any type of frequent flyer mileage, or other reward point accumulation program (excluding the YMCA Commit to Be Fit contest).
6. On or after April 12, 2010, a random draw will take place at the YMCA of Greater Moncton, 30 War Veterans Ave, Moncton New Brunswick, from all eligible point ballots received during the Contest Period. The drawn winner will be eligible to win the Grand Prize. The odds of winning the Prize will depend upon the total number of eligible point entries received during the Contest Period. The Contest Sponsors will attempt to contact potential winner, or, if under the age of majority, his or her parent or legal guardian, by telephone within two (2) business days after the draw. Proof of identification must be provided upon request. Before being awarded a Prize, potential winner and each potential winner’s travelling companion(s), as applicable, or, if under the age of majority, his or her parent or legal guardian, will be required to sign and return within the time stipulated by the Contest Sponsor(s), a full release and indemnity form stating that he/she has read and understood these official rules and regulations, grants all consents required, authorizes the Contest Sponsor(s) to broadcast, publish and disseminate his/her name, address, photograph, likeness, sobriquet and voice, in connection with any promotion or publicity, and/or for general news, entertainment and information purposes at no additional compensation to the potential winner and/or travelling companion(s), beyond the awarding of or participation in the Prize, accepts the Prize as offered and releases the Contest Sponsor(s) from any and all liability of any kind arising out of the potential winner’s and/or travelling companion’s, participation in this contest and receipt and use of the Prize. In the event that the potential winner and/or the travelling companion(s), as applicable, do/does not comply with all the provisions as contemplated in these official rules and regulations, Contest Sponsor(s) shall have the right to disqualify potential winner and/or travelling companion(s), and draw an alternate potential winner and/or travelling companion(s) and the Contest Sponsor(s) shall be fully and completely released and discharged from any liability or responsibility in this regard. The provisions and procedures referred to above relating to selection and notification of a potential winner and travelling companion(s), if applicable, shall be applied, with the necessary amendments, until a qualified winner and travelling companion(s) has/have been duly selected.
7. By entering this contest the entrants and participants automatically agree to accept and abide by these official rules and regulations. All decisions of the Contest Sponsor(s) with respect to any aspect of this contest, including without limitation the eligibility of entries, are final and binding on all entrants in all matters as they relate to this contest.
8. Winner and Guest are responsible for all ground transportation, all meals, beverages and entertainment, gratuities, merchandise, telephone calls, in-room charges, personal expenses of any kind or nature, and any other expenses not specifically described as included in the GRAND PRIZE.
- Grand Prize must be accepted as awarded and cannot be transferred, re-assigned, substituted or redeemed for cash.. Should WINNER and/or GUEST be unable to travel at the designated dates and times, GRAND PRIZE will be considered forfeit and awarded to an alternate WINNER. All prizes must be accepted as awarded. Grand prize may only be accepted by the person who qualified by entering to win via Y-Points Fidelity Club, except at the sole discretion of the YMCA.
- An estimated retail value for the Grand Prize is $3,000 CAD.
9. YMCA judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
10. The selected Qualifier may be required to return a signed release and acknowledgment form before being declared a winner.
11. By entering this Contest, each entrant consents to the use of his/her entry, name, and city of residence and/or photograph, voice or video recording in any publicity carried out by the YMCA, without further compensation. Winners consent to their photograph being taken by the YMCA for such use, without further compensation. All entries become the property of the YMCA.
12. This Contest is open to all residents of Greater Moncton, 19 years of age and older as of the date of entry, except employees of YMCA, its parent and affiliate companies; its representatives and agents, the Contest suppliers, any persons residing in their respective households [1] and any immediate family members [2]. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
13. No communications will be entered into except with the selected entrants.
14. Odds of winning depend on the number of eligible entries received. The YMCA is unaware of how many participants there may be. The winners may come from any eligible area of the city, so long as they otherwise qualify to enter the Contest.
15. The YMCA is collecting personal data about entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by the entrant unless the entrant provides the YMCA with explicit permission to do so as indicated on the entry form. Please see our Privacy Policy at www.ymcamoncton.com for full information on the company’s policy towards maintaining the privacy and security of user information.
16. By entering this Contest, entrants release and hold harmless the YMCA, its advertising and promotional agencies and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns (collectively the “Releasees”) from any liability in connection with this Contest or, if declared a winner, the prize(s). Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.
17. The YMCA assume no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the Contest. The YMCA reserve the right, in its sole discretion; to cancel or suspend the email portion of this Contest should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, the YMCA reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. If the identity of an entrant is disputed, the authorized account holder of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
18. All entries become the property of Contest Sponsor(s) who assume no responsibility for garbled, in audible, lost, late, delayed, destroyed or misdirected mail, voice messages, e-mail or any computer errors or malfunctions. No correspondence will be entered into except with contestants requesting contest official rules and regulations by mail or requesting names of prize winner(s) (for which a self-addressed, postage paid envelope must be included). Contest Sponsor(s) does/do not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. If for any reason, in the opinion of the Contest Sponsor(s), in its/their sole discretion, the contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its/their control, Contest Sponsor(s) reserve(s) its/their right to cancel, terminate, modify, amend or suspend the contest including canceling any method of entry, and select a winner from previously received eligible entries. Contest Sponsor(s) reserve(s) its/their right to modify the official rules and regulations of this contest without materially affecting the terms and conditions hereof. The Contest Sponsor(s) reserve(s) its/their right in its/their sole discretion to disqualify any individual it/they find(s) to be tampering with the entry process or the operation of the contest or to be acting in violation of these official rules and regulations or otherwise in a disruptive manner. Contest Sponsor(s) in its/their sole discretion, further reserve(s) its/their right to terminate the on-line portion, as applicable, of the contest and conduct the drawing from all on-line entries and all other entries (as applicable) previously received during the Contest Period. Any attempts to deliberately damage any web site or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Contest Sponsor(s) reserve(s) its/their right to seek remedies and damages to the fullest extent of the law. Contest Sponsors shall not be held responsible for any errors or negligence that may arise or occur in connection with the contest including any damage to an entrant’s computer equipment, system, software or any combination thereof, as a result of their participation in this contest or from downloading any material from the contest web site, where applicable.
19. This Contest will be run in accordance with these rules, subject to amendment by the YMCA. Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.
20. This contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this contest, each entrant consents to the collection, use and distribution of his/her personal information (information that identifies an entrant as an individual, such as home telephone number, age and home address) by the Contest Sponsor(s) for the purposes of implementing, administering and fulfilling this contest. Contest Sponsor(s) will not sell or transmit this information to third parties except for the purposes of administering this contest. Any inquiry concerning the personal information held by the Contest Sponsor(s) should be addressed to the Contest Sponsor(s) at 30 War Veterans Ave, Moncton New Brunswick.
21. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
a. Household is defined as a separate, self-contained residence which has a unique municipal address. Proof may be required to be provided to ensure compliance with this rule. The YMCA in its sole discretion will determine whether a household meets this condition.
b. Immediate family members are defined as parent(s) (including step parents), spouse (including common law and same sex), spouse of the father or mother (including common law and same sex), father-in-law (including common law and same sex), mother-in-law (including common law and same sex), brother (including step brother and brother-in-law), sister (including step sister and sister-in-law), children (including adopted and stepchildren) and grandparents.
